2. Acceptance of Terms

6. Client Responsibilities

The client is responsible for providing accurate and timely information required to complete the project.

This may include:

  • Company information

  • Logos

  • Brand guidelines

  • Text content

  • Images

  • Product information

  • Pricing information

  • Legal information

  • Domain and hosting access

  • Third-party account access

  • API credentials

  • Business requirements

  • Approvals and feedback

The client is responsible for ensuring that materials supplied to Media Tigers do not infringe the intellectual property, privacy, or other rights of third parties.

Delays in receiving required information, content, approvals, credentials, or feedback may affect the project timeline.


 

7. Design Services

For branding, graphic design, packaging, print, social media, and related creative services:

  • The approved scope determines the agreed deliverables.

  • Revisions are limited to the number specified in the quotation or proposal.

  • Significant changes after approval may be treated as additional work.

  • Final production files will be supplied according to the agreed scope.

  • Source files may or may not be included unless specifically stated.

  • Printing, production, photography, stock assets, fonts, licenses, and other third-party expenses may be charged separately unless included in the quotation.

Final approval by the client confirms acceptance of the approved design direction.


8. Website Development

Website projects may include WordPress, WooCommerce, custom web applications, landing pages, portals, integrations, or other technologies.

Unless specifically included in the proposal, the following may be charged separately:

  • Premium plugins

  • Premium themes

  • Software licenses

  • Hosting

  • Domain registration

  • SSL certificates

  • Paid APIs

  • Payment gateway charges

  • Third-party subscriptions

  • Stock images

  • Premium fonts

  • External services

  • Email or SMS charges

  • WhatsApp/API charges

The client is responsible for providing accurate website content and required business information.


 

9. WordPress and Plugin Services

Where WordPress services are provided, Media Tigers may use:

  • WordPress

  • Elementor

  • WooCommerce

  • SEO plugins

  • Security plugins

  • Caching systems

  • Backup systems

  • Other suitable plugins or technologies

Third-party plugins and themes are subject to their respective licenses, terms, compatibility, and update policies.

Media Tigers cannot guarantee that every third-party plugin, theme, API, or service will remain compatible indefinitely.

Where appropriate, we may recommend replacing unsupported, insecure, or incompatible software.



10. E-commerce Services

For WooCommerce and other e-commerce projects, the client remains responsible for:

  • Product information

  • Product pricing

  • Taxes

  • GST information

  • Shipping policies

  • Return and refund policies

  • Product legality

  • Customer service

  • Inventory information

  • Payment account ownership

  • Legal compliance

Media Tigers may integrate payment gateways and other third-party services but does not control the policies, uptime, approval process, transaction processing, or fees of those providers.



11. Application Development

Custom application projects may include:

SEO results depend on numerous factors, including:

  • Industry conditions

Advertising results may vary depending on:

  • Offer

  • Landing page performance

Media Tigers cannot guarantee a specific number of leads, sales, followers, impressions, or conversions.

Advertising spend paid to platforms such as Meta, Google, LinkedIn, or other third parties is separate from Media Tigers’ service fees unless explicitly stated otherwise.



15. Third-Party Services

Projects may depend on third-party services such as:

  • Zoho

  • Microsoft

  • Stripe

  • Razorpay

  • Hosting providers

  • Cloud providers

  • AI providers

  • API providers

  • Email services

  • CDN providers

Media Tigers is not responsible for outages, pricing changes, API changes, account suspensions, policy changes, service discontinuation, or technical failures caused by third-party providers.

Third-party services remain subject to their own terms and policies.



16. Domain, Hosting and Email

Where domain, hosting, server, email, or related services are arranged on behalf of a client:

  • Ownership remains with the party specified in the relevant agreement.

  • Renewal charges are the client’s responsibility unless otherwise agreed.

  • Third-party hosting limitations may affect Website performance.

  • Server outages outside Media Tigers’ control are not considered a development failure.

  • Email delivery may be affected by spam filters, DNS configuration, reputation, recipient servers, or third-party providers.

Clients should maintain appropriate administrative ownership and recovery access for important accounts.



17. Payments

Unless otherwise stated in a project proposal or agreement, projects may require an advance payment before work begins.

Payments may be structured around:

  • Advance payment

  • Design approval milestone

  • Development milestone

  • Testing milestone

  • Final delivery

  • Monthly retainer

  • Other agreed milestones

Work may be paused if scheduled payments are overdue.

Delays caused by pending payments may also affect the delivery schedule.

Additional work will normally be quoted separately.



19. Client Approval

The client is responsible for reviewing and approving:

  • Designs

  • Content

  • Website pages

  • Product information

  • Pricing

  • Functionality

  • Forms

  • Links

  • Technical specifications

Once a deliverable has been approved, substantial changes may be treated as additional work.



20. Project Delays

Project timelines are estimates based on the approved scope and availability of required resources.

Delays may occur due to:

  • Late content submission

  • Delayed approvals

  • Changes in scope

  • Payment delays

  • Third-party services

  • Hosting issues

  • API changes

  • Technical problems

  • Force majeure events

Where a delay is caused by circumstances outside Media Tigers’ reasonable control, the delivery timeline may be adjusted accordingly.



21. Intellectual Property

Unless otherwise agreed in writing:

  • Media Tigers retains ownership of its pre-existing design systems, methods, frameworks, templates, processes, reusable components, code libraries, tools, and know-how.

  • Third-party software remains owned by its respective licensors.

  • Client-owned materials remain the property of the client.

  • Final project deliverables will be transferred or licensed according to the terms specified in the applicable project agreement.

Payment of the agreed project fee does not automatically transfer ownership of third-party software, stock assets, fonts, plugins, themes, or licensed materials.



22. Portfolio Rights

Unless otherwise agreed in writing, Media Tigers may display completed work in its portfolio, website, presentations, social media, proposals, and marketing materials for the purpose of demonstrating its work.

If a project is confidential or subject to a non-disclosure agreement, Media Tigers will respect the applicable confidentiality requirements.

Clients who require complete portfolio confidentiality should notify Media Tigers before project commencement.



23. Confidentiality

Both parties may receive confidential business, technical, financial, marketing, or operational information during a project.

Each party agrees to use reasonable care to protect confidential information and not disclose it unnecessarily to unauthorized third parties.

Confidentiality obligations do not generally apply to information that:

  • Is already publicly available

  • Was lawfully known before disclosure

  • Becomes publicly available without breach

  • Is independently developed

  • Must be disclosed by law or lawful authority

Additional confidentiality requirements may be established through a separate NDA.



24. Website Content and Client Materials

The client is responsible for ensuring that all materials supplied for publication are lawful and accurate.

  • Pricing

  • Financial information

Media Tigers is not responsible for claims or inaccuracies contained in client-supplied materials.



25. Website Security

Media Tigers may implement reasonable security measures appropriate to the project.

However, no website or application can be guaranteed to be completely secure.

26. Maintenance & Support

Maintenance services are governed by the selected maintenance plan or agreement.

  • Performance monitoring

  • Bug fixing

  • Minor content changes

  • Technical support

Major redesigns, new functionality, application development, or substantial content work may be charged separately.



27. Backups

Where backups are included in a maintenance plan, Media Tigers will make reasonable efforts to maintain backups according to the agreed schedule.

However, backups should not be considered an absolute guarantee against data loss.

For critical applications, clients should maintain independent backup and disaster-recovery arrangements where appropriate.



28. Cancellation and Project Termination

Either party may request termination of a project subject to the terms of the applicable project agreement.

If a project is cancelled after work has commenced:

  • Fees for work already completed may remain payable.

  • Third-party costs already incurred may remain payable.

  • Approved milestones may remain payable.

  • Non-refundable license or service costs may remain payable.

  • Deliverables may be released according to the payment and project terms.

Specific cancellation and refund conditions may be stated in the individual proposal or agreement.



29. Refunds

Refund eligibility depends on the nature of the service and the applicable project agreement.

Because creative, development, consulting, and digital services may involve work performed specifically for a client, payments relating to completed or substantially completed work may not be refundable.

Any specific refund or cancellation terms agreed in writing will take precedence over this general provision.



30. Disclaimer
